Gita Patel Successfully Represents Albanian Trafficking Victim in Asylum Appeal

Gita Patel, instructed by Irene Tsherit at Barnes, Harrild & Dyer Solicitors, successfully represented an Albanian Trafficking Victim at her Asylum Appeal in the First-Tier Tribunal.

The appellant, a mother of two very young children, feared her traffickers would be able to locate her on her return to Albania; she claimed she would not be able to seek protection from her traditional family, especially her strict father, who had previously arranged her marriage and stopped her from further education.

Country guidance case of AM & BM (Trafficked Women) Albania CG [2010] UKUT 80 (IAC) which states how trafficking victims who have children outside of marriage are particularly vulnerable on their return to Albania and in some extreme cases, relatives of the trafficked women are forced to abandon the children.

Following a reserved Judgement, the Judge of the First Tier Tribunal allowed the appeal on the grounds of asylum and human rights.
