The penultimate seminar in our Autumn series of Personal Injury and Clinical Negligence presentations by Barrister Haroon Rashid is ‘Serious Personal Injury and Break in the Chain of Causation’.

This online seminar will ask the question “What happens when a serious injury is followed by negligent medical treatment?” This is a complex area of clinical negligence, so Haroon Rashid will examine and review the case law surrounding it.

These types of claims are often worth millions of pounds, where someone sustains a serious personal injury and needs medical treatment, but the subsequent treatment received in the hospital falls well below the expected standard and causes serious disability and loss.

The crucial question then becomes “Did the subsequent negligent medical treatment constitute a ‘novus actus interveniens’ breaking the chain of causation?”  

If the answer is yes, then the original defendants will not be liable for the consequences to the claimant following the intervening act – the negligent medical treatment received in the hospital.

If, however, the intervening act is found not to have broken the chain of causation, then the original defendant will remain liable for the harm suffered by the claimant, although they will have the right to seek a contribution from the negligent treatment provider.

This complex area of clinical negligence will be explored in detail throughout this hour-long virtual seminar on Tuesday 17/10/23 hosted by Personal Injury Barrister Haroon Rashid from 4 pm.
