Iraqi national whose appeal against deportation was allowed (conviction not serious enough and now spent in any case) but whose ILR application was then refused by the Home Office (although he had had 4 years ELR from 2001- 2005 and this should have entitled him to upgrade to ILR). There was no basis for refusing him ILR once the Tribunal had found his presence was not unconducive to the public good in allowing his appeal against deportation. Permission to apply for Judicial Review was granted and Treasury Solicitors consented to grant ILR after argument had taken place in the full Judicial Review hearing.
