Sarah Johnson Successfully Represented a Large UK Charity Against Race Discrimination Claims from Potential External Supplier

by Kenworthy's Chambers 12/09/2018

Sarah Johnson represented one of the UK's largest Health & Social Care Charity at a 3-day hearing at Liverpool Employment Tribunal against claims of race discrimination, harassment, unfair dismissal and breach of contract brought by claimant a self-employed yoga instructor against the Respondent.

The claimant argued how she was led to believe that the charity was going to use her services and a contract was being finalised. Sarah argued there were no claim for discrimination as none of the potential suppliers were offered a contract for the services, due to the expense of running the service, not the ethnicity of the claimant.

The further claims of breach of contract and unfair dismissal against the Charity were dropped at the beginning of the final hearing; due to there being no contract drawn up for the Claimant and with no official contract employment, no dismissal occurred with the Claimant not being employed by the Respondent.
