Robert Lassey Successfully Defends in a Newton Hearing At Leicester Crown Court

Robert Lassey successfully represented his client in a Trial of Issue at Leicester Crown Court. The defendant had pleaded guilty to four charges; Dangerous Driving, Driving with Excess Alcohol, Driving with No Insurance and Failing to Stop for the Police, but disputed the Crown's version of events as to the nature of the driving.

At the Newton hearing, the Learned Judge heard live evidence from the Crown witness in support of their case, and from Robert on behalf of his client. Following submissions from both parties, the Learned Judge accepted the defence version of events, and sentenced accordingly describing the hearing as "a very worthwhile exercise, and one which I am glad we undertook." As a result, Robert's client was afforded the full 1/3 credit and was handed a Suspended Sentence Order, a lenient sentence by the Learned Judge's own admission, and one which would doubtless not have been possible on the Crown's version of events.
