Patrick Cassidy Represents Family at Inquest into Death of 24-Year Old Care Home Resident

Patrick Cassidy, instructed by Philip Walsh of Clifford Johnston, represented the family of 24-year-old James Wheeler at a 5-day Article 2 Inquest at Stockport Coroners Court. At the time of Mr Wheeler's death, he was a resident of Cheddle Lodge Care Home, run by the Stockport Cerebral Palsy Society, having suffered with epilepsy and cerebral palsy.

Manchester South Area, Coroner Mr Christopher Morris found that the system of observations present on the night shift at Cheddle Lodge were fundamentally flawed. He found that the Article 2 duty applied to the Care Home, as they knew or ought to have known that there was a real and imminent threat of death if James had a seizure at night and did not receive an application of his "Rescue" medication. The Coroner went on to find that Mr Wheeler died of a seizure whilst unobserved.

As a result of the submission from the Family, the coroner is writing to the Government body "NICE", after the inquest evidence identified the absence of a National Guidance for Care homes in the management of Epilepsy.
