Mark Schwenk Successfully Obtains Permission for Judicial Review for Male Victim of Domestic Violence

Mark Schwenk, instructed by the Greater Manchester Immigration Aid Unit, has obtained permission to apply for judicial review of the refusal by the Secretary of State to grant leave to remain in the UK to a male victim of domestic violence.

The client is a Pakistani national who became subject to emotional and physical abuse from his spouse. The Home Office had refused his application to remain in the UK as a victim of domestic violence on the basis that he could not prove that this was the cause of the marriage breakdown. This was despite medical evidence which corroborated his account.
It is important to remember that anyone can potentially be a victim to domestic violence, says Mark. Domestic violence also covers non-physical abuse such as controlling behaviour, he added.
