John Nicholson Granted Permission for Judicial Review for Lesbian from Cameroon

by Kenworthy's Chambers 01/08/2017

John Nicholson, instructed by the Greater Manchester Immigration Aid Unit, has been granted permission for Judicial Review for a Lesbian Cameroonian. The Home Office's refusal was based on the lack of evidence in her involvement within the LGBT community as a "gay rights activist"; rather than her preference to have relationships with women. In Cameroon, homosexuality is illegal and custodial sentences from 6 months up to 5 years are implemented, along with a fine ranging from 20,000 to 200,000 francs; if the Cameroonian woman was to be deported back to Cameroon she would face a significant risk of persecution, as was decided by the Supreme Court in the landmark case of "HJ Iran and HT Cameroon".
